Health Care Regulatory Compliance and Reimbursement

Regulatory compliance for health care entities is complex, with federal and state laws governing most aspects of business operations: from organizational structure, to relationships with referrals sources, to purchasing and vendor contracts to billing payers for items and services. Faegre & Benson handles compliance and reimbursement matters by addressing your business challenges with practical, real world solutions.

We represent a broad array of health care providers and device manufacturers in structuring transactions and relationships, drafting and implementing compliance programs, and solving reimbursement issues.

Our health care attorneys devote a significant portion of their practices to False Claims Act, Anti-Kickback, Stark Law, EMTALA and HIPAA issues. We advise hospitals and health care providers regarding the structure of hospital/physician relationships; apprising clients of compliance risks and recommending structural and operational changes; working with suppliers and medical device manufacturers on relationships with referring physicians and facilities; responding to government investigations; and analyzing disclosure and repayment obligations relating to overpayments.

We assist our broad client base in the design, development, implementation and review of compliance plans and policies. We understand the critical role of internal monitoring and investigations for our clients' overall compliance goals.

Our compliance program expertise includes public and private health care billing and reimbursement issues, particularly with respect to Medicare Parts A and B, DMERC and Medicaid/Medical Assistance. For example, we assist clients with enrollment requirements, Medicare coverage and payment requirements for hospitals and other providers; hospital inpatient and outpatient billing; Medicare secondary payor rules; E&M coding; Part A cost-reporting and reimbursement; Part A, Part B and Medicaid administrative appeals; payment for ESRD services; change of ownership issues; and state law and managed care billing issues.

We maintain working relationships with representatives at CMS, OIG and regional and national Medicare contractors to provide our clients with the most accurate and up-to-date interpretations of those programs' ever-changing requirements.
